included an additional objection which raised concerns over the
planning process and increased pollution.

debate.
Members debated the application and the following comments were
amongst those noted:
- The
proposal was over intensive for the surrounding area.
- The
proposal would generate more traffic.
- There were not enough school places for the increased
dwellings.
- The
was a need to construct houses in the borough.
RESOLVED that
the Interim Head of Planning and Economic
Development be given delegated authority to grant planning
permission subject to:
(i) the prior
completion of an agreement under section 106 of the Town and
Country Planning Act 1990 to secure the provision of affordable
housing on the site and contributions towards: provision of
education measures, off-site highway works, provision and
maintenance of open space, integrated transport measures, improved
health facilities and improvements and maintenance of links towards
and over Bennerley Viaduct;
and
(ii) the following conditions:

Application for approval of the reserved
matters shall be made to the Local Planning Authority before the
expiration of three years from the date of this
permission.
Reason: To comply with
S92 of the Town and Country Planning Act 1990 as amended by S51 of
the Planning and Compulsory Purchase Act 2004.

The development hereby permitted shall be
commenced before the expiration of two years from the date of
approval of the last of the reserved matters to be
approved.

RESOLVED that

- There would be a loss of neighbour amenity.
RESOLVED that the application be
refused due to the
proposed extension by virtue of its excessive scale and massing
would represent an overdevelopment of the dwelling. The
extension would result in a significant loss of amenity for nos. 40
and 44 Sandy Lane. Accordingly, the proposal would be
contrary to Policy 17 of the Part 2 Local Plan (2019), Policy 10 of
the Broxtowe Aligned Core Strategy (2014) and the National Planning
Policy Framework (2019).
