The lateitemsforthisitem werenoted,includinganemailfroma residentneighbouringthe site,an amendmentto thenotes anda communicationfromBeeston andDistrictCivicSocietyrequestingthatnest bricksforswiftsbe included in thedesign.

 

Ms MargaretMetcalfe,objectingandCouncillorJ CPatrick,WardMember,addressedthe Committeepriortothegeneraldebate.

 

The Committeenotedthat theapplicanthadincludedtwoadditionalparkingspaces andhad identifieda pointof contactfor residents,as requested.Therewas a discussionabouttheimpacton lighttoneighbouringproperties.Itwas notedthatthe solarstudieshad beensubmittedwiththeapplicationandthese wereconsidered.

 

RESOLVEDthat planningpermissionbe grantedsubject tothe followingconditions:

 

1.      Thedevelopmentherebypermittedshall becommencedbefore the expirationof threeyearsbeginningwiththe dateofthispermission.

3.   No developmentshallcommenceuntil:

(i)  All necessarygroundwaterremedial measureshave beencompletedinaccordancewithRemediationMethod Statement(Ref 12292A June 2018) and;

(ii) Ithas beencertifiedto thesatisfactionof theLocal PlanningAuthoritythat necessaryremedialmeasureshavebeen implementedinfulland thatthey haverenderedthesitefreefromriskto humanhealthfromthe contaminantsidentified.

 

4.   No developmentshallcommenceuntila planto showthe locationof protectivefencing forthe treesshownto beretainedon drawingnumberP4693_100Rev Bhasbeen submittedto andagreedinwritingby theLocal PlanningAuthority.Theerectionof fencingfor theprotection ofthese retained treesshallbe undertakenin accordancewiththe agreed detailsbeforeany equipment,machineryor materialsarebroughton tothe sitefor the purposesof thedevelopment,and shallbe maintained until allequipment,machineryand surplusmaterialshavebeenremovedfromthesite.Nothingshall bestored orplaced inany areafencedinaccordancewiththisconditionand thegroundlevelswithinthoseareasshallnot bealtered,norshallany excavationbe made,withoutthewrittenconsentofthe LocalPlanningAuthority.

 

5.   No developmentshall commenceuntildetailsoftheconstructionsiteaccessandparkingarrangementsfor constructionvehicles havebeen submitted to andapprovedinwritingby theLocalPlanningAuthority.Constructionaccessand parkingshalltakeplacein accordancewiththe agreeddetails.

 

6.   No developmentaboveslab levelshallbe carriedout untilsamplesofthe materialstobe usedinthe facingwalls(includingwindowsanddoors)and rainwatergoodshave beensubmitted toandapprovedin  writing  by  theLocalPlanningAuthority,andthe developmentshallbe constructedonlyin accordancewiththosedetails.

 

7.   No developmentaboveslab levelshalltake placeuntila landscapingschemehasbeen submittedto andapproved inwritingbythe LocalPlanningAuthority.  Thisscheme shallincludethe followingdetails:

(a)        numbers,types,sizes andpositionsof proposedtreesandshrubs,

(b)       proposedhardsurfacing treatment,

(c)        planting,seeding/turfingofother softlandscapeareas,

(d)       proposedboundarytreatmentsincludingdetailsof thegateaccessto the BritishLegionsocialclub

(e)        a timetableforimplementation.

 

Theapprovedschemeshall becarriedout strictlyin accordancewiththe approveddetails.

 

8.   Theapprovedlandscapingshallbecarried outnotlaterthanthe firstplantingseasonfollowingthe practicalcompletionof thedevelopmentand any treesor plantswhich,withina periodof 5years,die, areremovedor havebecome seriouslydamaged ordiseased shallbe replacedinthe next


 

plantingseasonwith onesof similarsize andspeciesto thesatisfactionof theLocalPlanningAuthority.

 

9.   No building tobeerected pursuantto thispermissionshall beoccupiedor broughtinto useuntil:

(i)         Allnecessarygasandvapourbarrier andcleancoverremediationmeasureshave beencompletedinaccordancewithRemediationMethodStatement(Ref 12292AJune2018)and;

(ii)        Ithas beencertifiedtothesatisfactionoftheLocalPlanningAuthoritythat theremedialmeasureshavebeenimplementedinfulland thatthey haverenderedthesitefreefromrisktohumanhealthfrom thecontaminantsidentified.

 

10.   No deliveriesor collectionsbycommercial vehicles(excludingthedeliveryof urgentmedicalsupplies)shallbe madeto/from thesite exceptbetweenthe hoursof07:00- 22:00onanyday.

 

11.   Pilingor anyotherfoundationdesigns usingpenetrativemethodsshallnotbepermittedother thanwiththe priorwritten consentof theLocalPlanningAuthority,whichmaybegiven forthose partsof thesite whereithasbeen demonstratedthatthereis noresultant unacceptableriskto groundwater.Forareas wherepenetrativefoundationsarepermitted,a methodologyfor reducingnoiseandvibrationimpacton neighbouring buildings and residents shall besubmitted toand agreedinwritingbytheLocal PlanningAuthority priorto commencementofthe pilingactivity.Theactivityshallbe carriedout inaccordancewiththeapproveddetails.

 

12.   No constructionor sitepreparationworkinassociationwiththispermissionshallbe undertakenoutside ofthe hoursof07.30-18.00Mondayto Saturdayand atno timeon Sundaysor BankHolidays.Exceptionally,specificworksor operationsmaybecarriedoutoutsidethesetimes,butthesemustbe agreedinwritingwiththe LocalPlanningAuthority7 daysin advanceofbeingundertaken.

 

13.   Thetotal  ratinglevel resultingfromthe useof anyplant, machineryor equipmenthereby installedpursuant tothis permission,shallnotexceed theexistingbackgroundsound levelwhenmeasuredaccordingto BritishStandard BS4142:2014,at apointone metreexternalto thenearestnoisesensitivepremises.

 

14.   Thebuildingshall beconstructedand theglazing andventilationinstalledin accordancewiththespecificationdetailsin theAzymuthAcousticsUK reportRef AA0050,datedFebruary2018.

 

15.   Nopartofthedevelopmentherebypermittedshallbebroughtintouseuntilanapplicationfora TrafficRegulationOrder toremoveon-streetparkingalong EllisGrovehas beenmade.

 

16.   Thedevelopmentshallnot beoccupieduntilthe redundantvehicularcrossingsonEllisGrovehavebeenremovedandreplacedwithfull kerbsand thefootpathreinstatedto theHighwayAuthority specification.

 

17.   Thebuildingshall notbefirst occupieduntil theparking,turningand servicingfacilitieshave beenprovidedin accordancewith the approved


 

plansand constructedso asto preventthe unregulateddischargeofsurfacewatertherefromontothe publichighway.  Thesefacilitiesshall

 

thereafterberetainedintheagreedformforthelifetimeofthe developmentand shallnot beused forany purposeotherthan the parking/turning/loadingand unloadingof vehicles.

 

18.   Thebuildingshall notbe firstoccupieduntila TravelPlanStatementhas beensubmittedtoandapprovedinwritingbythe LocalPlanningAuthority.

 

19.   TheAutomaticOpeningVents inthe northeast elevationof theapartmentsshall onlybe openedinthe eventof afire andshall beobscurelyglazedto PilkingtonLevel4 or5 (orsuch equivalentglazing whichshallfirsthave beenagreedinwritingbythe LocalPlanningAuthority)and retainedinthisformfor thelifetime ofthe development.

 

20.   Theherebyapprovedapartmentsshall notbe occupiedother thanby personswho haveattainedthe ageof 55years,togetherwiththespouseor partnerof suchpersons,including awidowor widowerwhomay beunder 55yearsof age.

 

21.   Thebuildinghereby approvedshall befirst occupiedbyBelong Limited.

 

22.   Thesiteaccessshallbe providedinaccordancewiththe approveddrawingsbeforethe developmentis firstoccupied.

 

 

Reasons:

 

1.      TocomplywithS91 ofthe Townand CountryPlanningAct 1990as amendedby S51of thePlanningand CompulsoryPurchaseAct2004.

 

2.      Fortheavoidanceof doubt.

 

3.      Thedevelopmentcannotproceed satisfactorilywithouttheremedialmeasuresbeing undertakenin advance of  development  commencing,  inthe interestsof protectinggroundwaterand inaccordancewiththe aimsof PolicyE27oftheBroxtoweLocalPlan(2004).

 

4.      Nosuch detailsweresubmitted withthe applicationand thedevelopmentcannotproceedsatisfactorily withouttheoutstandingmattersbeingagreed inadvanceofdevelopmentcommencingto ensurethedetailsare satisfactory,in theinterestsof retainingthe treesonthe siteboundarywith BarrydaleAvenueandinaccordancewiththeaimsofPolicy10 of  theAlignedCoreStrategy(2014).

 

5.      Nosuch detailsweresubmitted withthe applicationand thedevelopmentcannotproceedsatisfactorily withouttheoutstandingmattersbeingagreed inadvanceofdevelopmentcommencingto ensurethedetailsare satisfactory,in theinterestsof highwaysafety,to avoidconflictwiththe tramandto protectresidentialamenityand inaccordancewiththe aimsof Policy10 ofthe AlignedCore Strategy(2014).


 

6.      Fulldetails werenot submitted,intheinterestsof theappearanceofthe developmentandinaccordancewiththe aimsof Policy10 oftheAlignedCore Strategy.

 

7.      Nosuch/insufficientdetailsweresubmittedandtoensurethatthedetailsare satisfactoryin theinterestsof theappearanceof thearea,to ensurea satisfactorystandardof amenityand inaccordancewiththe aimsofPolicyH7 ofthe BroxtoweLocalPlan(2004)andPolicy10 oftheAlignedCore Strategy(2014).

 

8.      Toensurethe developmentpresentsa morepleasantappearanceinthe localityandinaccordancewiththeaimsof Policy10 oftheAlignedCoreStrategy(2014).

 

9.      Inthe interestsofpublichealth andsafetyand inaccordancewiththeaimsofPolicyE29 oftheBroxtoweLocalPlan (2004).

 

10.   Toprotect nearbyresidentsfromexcessivenoiseand inaccordancewiththe aimsofPolicy10 ofthe AlignedCore Strategy(2014).

 

11.   To protect groundwaterfrom contaminationand nearbybuildingsand residentsfromnoiseandvibrationinaccordancewiththe aimsofPoliciesE29 andH7 ofthe BroxtoweLocalPlan (2004).
