This application has been called to Planning Committee by Councillor M Radulovic MBE.

 

There were no late items to be considered with regards to the application.

 

Daniel Hayes, applicant, addressed the Committee prior to the general debate.

 

The debate focussed on the impact of the proposed development on the openness and amenity of the Green Belt.  There was also a discussion about very special circumstances.  

 

RESOLVED that the allocation RESOLVED that the application be granted subject to the following conditions:

 

1.  The development hereby permitted shall be commenced before the expiration of three years beginning with the date of this permission.

 

Reasons: To comply withS91 ofthe Townand CountryPlanning Act1990asamended by S51 ofthe Planningand CompulsoryPurchase Act2004.

 

2.  The development hereby permitted shall be carried out in accordance with the site location plan and proposed block plan CF/DH/21/36/01 Rev C and proposed ground floor plan and elevations CF/DH/21/6/02 Rev C received by the Local Planning Authority 11 October 2021.

 

Reasons: For theavoidance of doubt.

 

3.  No building operations shall be carried out until details of the manufacturer, type and colour of the brick and tiles to be used have been submitted to and approved in writing by the Local Planning Authority, and the development shall be constructed only in accordance with those details.

 

Reasons: To ensurethedevelopment presentsa satisfactorystandard ofexternalappearance, inaccordance withthe aimsofPolicy17of theBroxtowe Part2 LocalPlan(2019) andPolicy 10oftheAlignedCore Strategy(2014).

 

4. (a) No part of the development hereby approved shall be commenced until an investigative survey of the site has been carried out and a report submitted to and approved in writing by the Local Planning Authority. The survey must have regard for any potential ground and water contamination, the potential for gas emissions and any associated risk to the public, buildings and/or the environment. The report shall include details of any necessary remedial measures to be taken to address any contamination or other identified problems.

 

(b)No building to be erected pursuant to this permission shall be first occupied or brought into use until:

 

i) all the necessary remedial measures have been completed in accordance with the approved details, unless an alternative has first been approved in writing by the Local Planning Authority; and

 

ii) it has been certified to the satisfaction of the Local Planning Authority that the necessary remedial measures have been implemented in full and that they have rendered the site free from risk to human health from the contaminants identified, unless an alternative has first been approved in writing by the Local Planning Authority.

 

Reasons: Inthe interestsofpublichealth andsafety andinaccordance withPolicy 19of theBroxtoweLocal Plan(2019).

 

5.  Notwithstandingthe provisions ofthe TownandCountry Planning(General PermittedDevelopment) Order2015, or anyorderrevoking orre-enactingthis order,noextensions, enlargements,roofalterationsoroutbuildingsshall be carried outtothe newdwelling herebyapprovedwhichcomewithinClass A,B,C, DorE ofSchedule2 Part1 ofthe Orderwithoutthe priorwrittenpermission oftheLocal PlanningAuthority byway ofa formalplanning permission.

 

Reasons: Toretainasense ofspaciousness inthe areato ensurefuture occupiershave asatisfactory degreeofamenity,inaccordance withthe aimsof Policies17and 23of theBroxtowePart2 LocalPlan(2019)and Policies10and11of theAligned CoreStrategy (2014).

 

6.  Prior to thecommencement ofdevelopment, details of areport, preparedinaccordance withtheprovisionsofthecurrentBS4142shall first havebeen submittedto andapproved inwritingby theLocal PlanningAuthority.Predictions shallbe containedin thereportwhich setsout: alargescale planoftheproposeddevelopment; noise sourcesand measurement/predictionpointsmarked ona plan;a list ofnoisesources; alistofassumed noiseemission levels;detailsofnoise mitigationmeasures; descriptionofnoise calculationprocedures; noise levelsata representativesample ofnoise sensitive locations; acomparisonofnoise levelwithappropriatecriteria.Wherecriteria areexceeded atany location theapplicant shouldexplainwhy thatexcess isimmaterial orwhat furthermitigation willbeundertaken toensurethatcriteriawillbemet. Thedevelopmentshall thereafterbe constructedin accordancewiththe approveddetails andretained forthe lifetimeof thedevelopment.

Reasons: Intheinterestsofpublichealth andsafety andin accordancewithPolicy 19of theBroxtowe Part2 LocalPlan(2019).

 

7.  Nodevelopment shalltakeplaceuntil alandscapingscheme hasbeen submittedto andapproved bytheLocalPlanningAuthority.This schemeshallincludethe followingdetails:

 

(a)    trees,  hedges and  shrubs  to  be  retained  and  measures  for  their  protection  during  the  course  ofdevelopment

(b)   numbers,types, sizesand positionsof proposedtrees andshrubs

(c)    proposedboundary treatments

(d)   proposedhard surfacing treatment

(e)    proposedlightingdetails

(f)     planting, seeding/turfingofother softlandscape areas

 

The approved schemeshall becarriedoutstrictly inaccordance withtheagreed details.

 

Reasons: Nosuch detailsweresubmitted andto ensurethatthedetailsare satisfactoryin theinterests ofthe appearanceoftheareaand inaccordancewith theaims ofPolicy 17of theBroxtowe LocalPlan(2019) andPolicy 10oftheAlignedCoreStrategy (2014)

 

8.Theapprovedlandscaping shallbecarriedout notlaterthanthe firstplanting seasonfollowingthe substantialcompletionof thedevelopment oroccupationof thebuilding(s), whicheveristhe soonerand anytrees orplantswhich,withina period of5 years,die, areremoved orhave becomeseriously damagedor diseasedshallbereplaced inthe nextplantingseason withones ofsimilarsizeand speciestothe satisfactionof theLocalPlanningAuthority,unlesswrittenconsent hasbeen obtainedfromtheLocal PlanningAuthority fora variation.

 

Reasons: Nosuch detailsweresubmitted andin accordancewiththeaimsofPolicy17of theBroxtowe LocalPlan(2019)and Policy10oftheAlignedCore Strategy(2014).

1.  TheCouncil hasacted positivelyand proactivelyin thedetermination ofthisapplication byworking todetermine itwithinthe agreeddetermination timescale.

 

2.  Contractorsshould limit noiseworksbetween08.00 and18.00 hoursMonday toFridayand 13.00 hourson Saturdaysand nonoisy workson Sunday/BankHolidays

 

3.   Burningofcommercialwaste isa prosecutableoffence. Italsocauses unnecessarynuisancetothose inthe locality.Allwaste shouldberemoved byanappropriately licensedcarrier.
