The application was brought before the Committee by Councillor M Brown.
There were late items comprising further comments from the Highways Authority. The Highways Authority commented that one comments had been received relating to the positioning of the garage and impact of the local wildlife.
There were two public speakers, Mrs Shaw, applicant, and Councillor M Brown, Ward Member.
The Committee considered all the representations presented to it and opened the debate, which covered that the applicant was suitable for the area and would not adversely affect the Green Belt.
RESOLVED that the Head of Planning and Economic Development be given delegated authority to grant advertisement consent subject to:
1. The development hereby permitted shall be commenced before the expiration of three years beginning with the date of this permission.
Reason: To comply with S91 of the Town and Country Planning Act 1990 as amended by S51 of the Planning and Compulsory Purchase Act 2004.
2. The development hereby permitted shall be carried out in accordance with the following plans received by the Local Planning Authority on 17 August 2026:
· Site Location Plan Revision A (drawing no.D302)
· Proposed Block Plan Revision A (drawing no.D301)
· Proposed Floor Plans and Elevations Revision A (drawing no.D101)
Reason: For the avoidance of doubt.
3. The proposed development shall be constructed using materials as annotated on the approved plans unless otherwise agreed in writing by the Local Planning Authority
Reason: To ensure a satisfactory standard of external appearance and in accordance with the aims of Policy 10 of the Aligned Core Strategy (2014) and Policy 17 of the Part 2 Local Plan (2019).
4. No part of the development hereby permitted shall be brought into use until a dropped vehicular footway crossing is available for use and constructed in accordance with the Highway Authority specification to the satisfaction of the Local Planning Authority.
Reason: In the interests of Highway Safety and in accordance with the aims of Policy 17 of the Broxtowe Part 2 Local Plan (2019) and Policy 10 of the Aligned Core Strategy (2014).
5. No part of the development hereby permitted shall be brought into use until all drives and any parking or turning areas are surfaced in a hard-bound material (not loose gravel) for a minimum of 5.5 metres behind the Highway boundary. The surfaced drives and any parking or turning areas shall then be maintained in such hard bound material for the life of the development.
Reason: To reduce the possibility of deleterious material being deposited on the public highway (loose stones etc.) and to ensure surface water from the site is not deposited on the public highway causing dangers to road users and in accordance with the aims of Policy 17 of the Broxtowe Part 2 Local Plan (2019) and Policy 10 of the Aligned Core Strategy (2014).
Notes to Applicant
1. The Council has acted positively and proactively in the determination of this application by working to determine it within the eight week determination timescale.
2. The proposed development lies within an area that has been defined by the Mining Remediation Authority as containing coal mining features at surface or shallow depth. These features may include: mine entries(shafts and adits); shallow coal workings; geological features (fissures and break lines); mine gas and former
surface mining sites. Although such features are seldom readily visible, they can often be present and problems can occur, particularly as a result of new development taking place. Any form of development over or within the influencing distance of a mine entry can be dangerous and raises significant land stability and public safety risks. As a general precautionary principle, the Mining Remediation Authority considers that the building over or within the influencing distance of a mine entry should be avoided. In exceptional circumstance where this is unavoidable, expert advice must be sought to ensure a suitable engineering design which takes account of all relevant safety and environmental risk factors, including mine

Any intrusive activities which disturb or enter any coal seams, coal mine workings or coal mine entries (shafts and adits) requires a Mining Remediation Authority Permit. Such activities could include site investigation boreholes, excavations for foundations, piling activities, other ground works and any subsequent treatment
of coal mine workings and coal mine entries for ground stability purposes. In areas where shallow coal seams are present caution should be taken when carrying out any on site burning or heat focused activities. If any future development has the potential to encounter coal seams which require excavating, for example excavation of building foundations, service trenches, development platforms, earthworks, noncoal mineral operations, an Incidental Coal Agreement will be required. 3. The proposal makes it necessary to extend a vehicular crossing over a footway of the public highway. These works shall be carried out to the satisfaction of the Highway Authority. You are therefore required to contact the County Council's Customer Services to arrange for these works on telephone 0300 500 80 80.
4. The garage existing structure might be constructed using asbestos material that must be tested. Should asbestos be present, the materials have to be removed in an appropriate and safe manner by a fully licensed removal company.
