11.1

The following motion has been submitted by Councillor V C Smith:

 

On 1 May 2026, the Renters Rights Act came into force in England. Among other things, this legislation banned Section 21 ‘no fault’ evictions, removed fixed-term tenancies, and banned the practice of rent bidding. The Act also placed a number of new duties on local authorities regarding enforcement of the new regulations in the private rented sector. More information on these duties as they relate to Broxtowe can be found here. Concerns have been raised about the ability of the tribunal system to handle an increase in cases in a timely manner and the levels of funding provided to councils.

 

This Council welcomes the reforms to renters rights in so far as they improve security for tenants. However, this Council also acknowledges the significant limitations of the legislation and lack of sufficient funding for local authorities expected to enforce the new regulations.

 

This Council resolves to write to the Minister for Housing, Communities, & Local Government, stating our position and calling on the government to:

 

·       introduce further measures to redress the power imbalance between tenants and landlords, including rent caps and closing eviction loopholes;

·       provide full and sufficient funding for local authorities to ensure proper, effective enforcement;

·       empower local authorities to deliver social housing programmes at scale to further address the housing crisis.

11.2

The following motion has been submitted by Councillor G Bunn:

“This Council notes that:

 

·       Residents near Bramcote/Stapleford, extending down into Toton and Chilwell, suffer frequent disturbances from anti-social driving, including high speed car races on the A52.

·       That this behaviour is dangerous and has caused several accidents, including the crash last year.

·       That despite the reduction in incidents at the Toton tram stop following the council and partners’ interventions, there continue to be issues on and around the A52 causing considerable disruption and fear for local residents.

·       That this issue is not restricted to Beeston, it happens elsewhere in Broxtowe and further afield in Nottinghamshire and Derbyshire.

 

We call upon this Council to:

 

·       Continue working constructively with local partners to do all it can to prevent these incidents to support and protect our local residents.

·       Write to the government calling for greater support for local police forces to tackle this issue, including the capacity, technology and training required are available.

·       Write to Nottinghamshire Chief Constable Steve Cooper asking for additional resources including speed and monitoring cameras on the A52 to help scope the issue and identify offenders, as well as the reinstatement of the Nottinghamshire-wide operation to tackle this issue and share learning

·       Write to Broxtowe MP Juliet Campbell asking for her to raise this issue in parliament and push for greater investment in local government and police resources to enable them to tackle ongoing issues like these.”

Chief Officer Employment Committee

12 October 2026

 

The Chief Officer Employment Committee, at its meeting on 12 October 2026, will consider the recruitment of Directors. The agenda and associated information has been circulated to all Councillors and the recommendation will be reported to full Council for consideration following the Committee’s meeting on 12 October 2026.

 

Council is asked to CONSIDER the recommendations from the Chief Officer Employment Committee and RESOLVE accordingly.

13.

Appointments to Brinsley Parish Council

In accordance with the Scheme of Delegation Chapter 3, Part 1 of the Council’s Constitution 9.11, the Chief Executive, following consultation with the Leader of the Council and, where possible, the Leader of the Opposition, shall have the power to allocate any new functions of the Council, or a function which has not been allocated under this Scheme, to the Officer (including the Chief Executive), which the Chief Executive considers most appropriate to perform the function. This enhances delegated urgency powers to the Chief Executive in light of any pandemic or other such circumstances.

 

On 24 September 2026, the Chief Executive delegated these powers to himself to make temporary appointments, by order, to persons to fill all or any of the vacancies at Parish and or Town Councils, where the number of vacancies renders the Council unable to act, until such time as other councillors are co-opted or elected and take office in accordance with Section 91 (1) of the Local Government Act 1972.

 

In pursuance of the Power conferred upon it by Section 91 (1) of the Local Government Act 1972, the Council has appointed four Councillors to act as Members of Brinsley Parish Council until an election has been held or new Councillors have been co-opted to fill such vacancies as shall constitute and re-establish a quorum on the Parish Council.

 

Council is asked to NOTE the appointments by Broxtowe Borough Council of Councillors J M Owen, P J Owen, M Radulovic MBE and K Woodhead to Brinsley Parish Council, and the use of the Chief Executive’s delegated powers.

17.

Attendance at Meetings

The Local Government Act 1972 states that when a Councillor fails to attend any meeting for six consecutive months from the date of their last attendance, then, subject to certain exceptions, they cease to be a Member of the authority, unless the Council accepts a reason for the failure to attend before the six months expires. Councillor S A Bagshaw is currently unable to attend Council meetings due to personal circumstances, and in these circumstances, it is put before Members to consider a dispensation under Section 85 (1) of the Local Government Act 1972 for the period of six months from 15 October 2025 before which forfeiture applies.

 

Council is asked to CONSIDER a dispensation for Councillor S A Bagshaw for a period of six months from the date of this meeting and RESOLVE accordingly.
